MACK DAVID STEWART AND ANGIE GERAGE STEWART, born Gerage, husband and wife, who declared that they are married to and residing with each other, both residents of and domiciled in the Parish of East Baton Rouge, State of Louisiana, who further declared their current mailing address to be 20011 Tucker Road, Zachary, Louisiana, 70791;

STEWART BUILT HOMES, INC., a Louisiana Corporation domiciled in the Parish of East Baton Rouge, State of Louisiana, represented herein by its duly authorized officer, ANGIE G. STEWART, as per Resolution recorded as Original 979, of Bundle 10268, of the official Records of the Parish of East Baton Rouge, State of Louisiana, filed on the 9th day of December, 1991. Stewart Built Homes, Inc. further declared their current mailing address to be 19993 Tucker Road, Zachary, LA 70791;
TAX IDENTIFICATION NUMBER — 72-1010373
Who declared that Appearer, STEWART BUILT HOMES, INC., purchased the following described Property from MACK DAVID STEWART AND ANGIE GERAGE STEWART on the 16th day of April, 1993:
Two (2) certain tracts or parcels of land, together with all improvements thereon, located in the City of Zachary, Parish of East Baton Rouge, State of Louisiana, being designated as LOTS OF THIRTY FIVE (35) and FORTY SEVEN (47) of MYRTLE HILL SUBDIVISION, more particularly shown on the Official Final Plat of Myrtle Hill Subdivision, recorded as Original 611 of Bundle 10394 of the official records of the Parish of East Baton Rouge, State of Louisiana.
Said Act of Sale is recorded as Original 362 of Bundle 10395 of the Official Records of the Parish of East Baton Rouge, State of Louisiana.
Subsequently, the Declarations of Covenants and Restrictions for Myrtle Hill Subdivision were filed as Original 561 of Bundle 10396 of the Official Records of the Parish of East Baton Rouge, State of Louisiana.
STEWART BUILT HOMES, INC. herein appears to acknowledge that the property is subject to the Declarations of Covenants and Restrictions for Myrtle Hill Subdivision and hereby ratifies those restrictions as if they had personally appeared in the original act.
One purpose of this document is to make Lots 35 & 47 of Myrtle Hill Subdivision subject to the Declarations of Covenants and Restrictions for Myrtle Hill Subdivision.
Appearers furthermore have discovered that there is an exception that needs to be made to the original declarations of covenants and restrictions in that Article 4.4 — c. should be amended to add the following: "however, an exception to this rule shall be Lot 7, 8, 9, 17 & 18, which shall have a front entry, if possible, if approved by the Council".
Thus, the entire Article 4.4 should read follows:
4.4 General Restrictions
Each lot shall have the following restrictions:
a. A house shall be one (1) detached single family dwelling not to exceed two and one-half (2 ½) stories in height;
b. The private garage shall have space for no more than three (3) vehicles;
c. Private garages or carport shall load from the side or rear and shall not face the street fronting the lot, except garages constructed on corner lots; however, an exception to this rule shall be Lot 7, 8, 9, 17, & 18, which shall have a front entry, if possible, if approved by the Council.
d. Housing constructed on corner lots shall include an attached or detached fully enclosed garage with a standard garage door;
e. Detached servants’ quarters or any other detached structure shall be constructed only with the prior written approval of the Council.
THUS DONE AND PASSED in my office in the City of Zachary, State of Louisiana, on this 7th day of May, 1993, in the presence of me, Notary, and the undersigned competent witnesses after reading of the whole.
