BE IT KNOWN, that on this 18th day of June, 1993, before me, the undersigned Notary Public, duly commissioned and qualified in and for the competent witnesses, personally came and appeared:
MACK DAVID STEWART AND ANGIE GERAGE STEWART, born Gerage, husband and wife, who declared that they are married to and residing with each other, both residents of and domiciled in the Parish of East Baton Rouge, State of Louisiana, who further declared their current mailing address to be 20011 Tucker Road, Zachary, Louisiana 70791; and
AARON (NMI) HULL and ROSIA GILMORE HULL, born Gilmore, both persons of the full age of majority, domiciled in the Parish of East Baton Rouge, State of Louisiana, who declared that they have been married but once and then to each other, who further declared their correct mailing address to be 3851 Shaffett Lane, Zachary, Louisiana 70791;
Who declare that they are the owners of the following described property situated in the City of Zachary, Parish of East Baton Rouge, State of Louisiana:
Eight (8) certain lots of parcels of ground, being LOT NUMBERS 3C-A, 3C-B, 3C-C, 3C-D, 3C-E, 3C-F, 3C-G, and 3C-H of Lot 3C of the Albert L. East, III property located in Section 82, Township 4 South (T4S), Range 1 West (R1W), City of Zachary, East Baton Rouge Parish, Louisiana, as more fully shown by the plat of M. Gregory Breaux, Registered Professional Land Surveyor, dated the 30th day of December, 1992, being entitled “Map Showing The Subdivision Of The Northerly 3.014 Acres Of Lot 3C Of The Albert L. East, III Property Located In Section 82, T4S, R1W, Greenland Land District (GLD) Of Louisiana, City of Zachary, East Baton Rouge Parish, Louisiana For Mack David Stewart and Angie Gerage Stewart”. Said plat is recorded as Original 970 of Bundle 10407 of the official records of the Parish of East Baton Rouge, State of Louisiana.
That they do, by this instrument, wish to amend the Restrictions for Lots 3C-A through 3C-H of Lot 3C, recorded as Original 970 of Bundle 10407 for the official records of the Parish of East Baton Rouge, State of Louisiana.
Appearers declare that they wish to amend Article 3(d) to read as follows: “No building or part of a building, that has previously been used for any purpose whatsoever, may be moved onto any lot in said subdivision for any purpose unless approved by the Architectural Control Committee.” Thus, the entire Article 3 should read as follows:
3 Area and Finish
The minimum requirements for residential structures are set out as follows:
a. No single-story dwelling shall be erected on any lot containing less than Fourteen Hundred (1,400) square feet of floor space or living space, exclusive of garages, carports and porches; and no two (2) story dwelling shall be erected on any lot containing less than twelve hundred (1,200) square feet of living space on the ground floor, exclusive of garages, carports and open porches.
b. Exteriors of residential structures and garages shall be built only of brick, brick-veneer, or siding and any combination thereof. The exterior shall be at least fifty (50) percent brick or brick-veneer.
c. All residences having an air space between the ground and the first floor shall be erected so that such air space shall be enclosed on the front side of the residence.
d. No building or part of a building, that has previously been used for any purpose whatsoever, may be moved onto any lot in said subdivision for any purpose unless approved by the Architectural Control Committee.
e. No residence shall be occupied until fully completed or until the exterior walls and roof have been completed and covered with one of the materials enumerated in sub-paragraph “b” above.
Appearers hereby certify by their signatures that they amend and ratify these amendments to the restrictions in any office in the City of Zachary, State of Louisiana on this 18th day of June, 1993 in the presence of me, Notary, and in the undersigned competent witnesses after reading of the whole.
